Smoke, soot and ash damage claims

Smoke damage is easy to underestimate and hard to remove. Residue settles into insulation, ductwork, fabrics and porous surfaces, and a surface wipe-down rarely fixes it.

Why these claims get underpaid

Insurers often propose a quick cleaning when the residue calls for more: replacing insulation, cleaning or replacing HVAC systems, sealing or replacing porous materials, and professional testing. Homes miles from the flames can be affected.

Building a stronger smoke claim

  • Ask whether the insurer performed any testing, and request the results
  • Consider independent environmental or industrial hygiene testing
  • Keep notes on odors, symptoms and visible residue
  • Don't throw out affected items until they are documented
  • Keep cleaning invoices and air purifier receipts

Questions we hear

The insurer says a cleaning is enough, but my home still smells. What can I do?

You can ask for re-inspection and testing and support your position with independent findings. If the insurer refuses to take a fair look, that can become part of a bad faith claim.

Every case is different and depends on its own facts and the law. Amounts shown are gross recoveries, before attorney’s fees and costs. Where shown, “carrier first offered/paid” is what the insurer had offered or paid before the client retained counsel. Client names and identifying details are omitted.
